Crush or Flush / Spring Break Essentials Giveaway Official Rules (“Official Rules”)

NO PURCHASE NECESSARY TO ENTER OR WIN. Standard text messaging rates apply to each text message sent or received as provided in your wireless rate plan. (Contact your carrier for pricing plans and details.) Online entries will be subject to standard Internet access and usage charges imposed by your Internet service provider. The Spring Break Essentials Giveaway (“Giveaway”) begins at 8 A.M. PACIFIC Time on March 15, 2009 and ends on April 15, 2009, at 9:00 P.M. PACIFIC Time (the "Promotion Period"). 

ELIGIBILITY
This Giveaway is sponsored by Crush or Flush and is open to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older as of the date of entry. Employees and their immediate families, including household members (whether related or not) of Crush or Flush™ (“Sponsor or Crush or Flush”),  IceBreaker U.S., Inc. (doing business as Crush or Flush), Alltel, AT&T Wireless, Boost Mobile, Cricket Wireless, MetroPCS, T-Mobile, Verizon Wireless, Virgin Mobile and their affiliates, subsidiaries, divisions, vendors and advertising and promotion agencies are not eligible. Giveaway is void in Canada, Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries and where prohibited by law.

HOW TO ENTER
There are four ways to enter – (3) automatically and (1) by mail:
1. Crush or Flush Log-in Entry:  Create, if you do not already have one, a live profile on Crush or Flush during the Promotion Period. A live profile is defined as containing at least one approved (by Sponsor) face picture of yourself. You may create a profile by going to http://crushorflush.com. You will earn one automatic entry every time you log into CrushorFlush.com during the Promotion Period*. The Sponsor collects personal information from each entrant as part of the profile process. The information collected is subject to the Sponsor's Privacy Policy posted at www.CrushorFlush.com. Use of the Sponsor's website is governed by the Sponsor's Terms of Use at CrushorFlush.com.
2. Sending gifts on CrushorFlush.com:  One (1) entry will be automatically given for each gift you send using the Crush or Flush gifting service
3. Golden Ticket Branded Profile: Periodically, when browsing picture profiles on Crush or Flush, you will see a product picture profile instead of a profile of a person. This is called a Golden Ticket profile. If you choose to “Crush” the Golden Ticket you will also earn an automatic entry to win.
4.  By Mail: You may also enter by mail without creating a profile, uploading a picture, or “Crushing” a Golden Ticket. To enter by postal mail, send a 3” x 5” card with your first/last name, address, daytime telephone number (including the area code), age, and e-mail address (if any) postmarked by 4/15/09, to be received no later than 4/22/09, to: Crush or Flush Giveaway, 227 Bellevue Way NE #168, Bellevue, WA 98004.  Only one entry per envelope. Reminder: it is free to sign up for Crush or Flush and create a profile at www.CrushorFlush.com.

*There is a maximum of 1,000 entries per entrant allowed either by automatic entry or by mail, or a combination of entry methods listed above during Promotion Period. Any attempt to obtain more than 1,000 entries by using different or multiple identities, cell phone numbers, log-ins, nicknames, or automatic entry software or any other method during Promotion Period is prohibited and will result in disqualification.  All entries become exclusive property of Sponsor, and none will be acknowledged or returned.  Proof of sending or submission will not be deemed to be proof of receipt by Sponsor.

PRIZES
The following prizes are available to be won (“Prizes”). The odds of winning depend upon the number of eligible automatic and mailed entries received.

Chevron Gas Cards:  The Chevron Gas Cards let recipients buy gas at any Chevron Gas Station.  Participants can locate the nearest Chevron Gas Station at www.chevron.com

iTunes Gift Card:  The iTunes Gift Cards let recipients buy music, TV shows, movies, audio books, and more from the iTunes Store at www.apple.com/itunes.

Chevron Gas Cards and iTunes Gift Cards will be shipped to winners no later than fourteen (14) business days after receipt and verification of all required documents. In the event that a Prize becomes unavailable at the time it is claimed, Sponsor - at its sole discretion - reserves the right to substitute another prize of equal or greater value. Unless otherwise specified, no substitution or transfer of prizes is allowed. All taxes or other assessments are the sole responsibility of the winners.

GIVEAWAY DRAWING & WINNER VERIFICATION
A random drawing will be conducted by Crush or Flush on or about 4/28/09 from among all eligible automatic and mailed entries received during the promotion period. The number of entries per person will be determined based on the number of log-ins, each gift sent on the site as of the last day of the Promotion Period, and Golden Ticket Crushes combined with the number of write-in entries from the same person (if applicable) up to a combined maximum total of 1,000 entries per entrant during Promotion Period. Winners will be notified by text message or voice phone call via the cell phone number used to register with Crush or Flush, or by mail to the address indicated on the mail in entry. As a condition of acceptance of a Prize, except where prohibited, winners acknowledge that their Crush or Flush nickname and/or real first name (not last name), photograph, likeness, voice, opinions, hometown and state may be used for promotional purposes in any manner Sponsor chooses without further payment or consideration. Winners shall be required to fill out such forms and releases as deemed necessary by the Sponsor to verify compliance with these Official Rules and award the Prize. If all required documents are not completed as specified, are not received by the Sponsor within ten (10) business days of the date on the Prize notification, or if the potential Winner is found to be an ineligible, entrant will be disqualified and an alternate entrant will be selected from among all remaining eligible entrants. If three eligible, alternate winners are contacted for a single prize, and the prize is not claimed after ten (10) business days of the date of Prize notification, the prize will be forfeited. The Sponsor reserves the right to verify eligibility of the Winners, including requiring proof that a potential Winner is the holder of the cell phone number provided upon submitting a profile.  In the event of a dispute over a winning entry between two or more parties, the registered holder of the cell phone number indicated upon submitting a profile shall be awarded the Prize. By participating in the Giveaway, each participant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Giveaway. Winning a Prize is contingent upon fulfilling all requirements set forth herein. 

GENERAL CONDITIONS
The Sponsor reserves the right to cancel or modify this Giveaway if fraud, technical failures or any other factor beyond the Sponsor's reasonable control impairs the integrity of this Giveaway as determined by the Sponsor in its sole discretion. In such event, the Sponsor reserves the right to award any remaining Prizes at random from among any eligible entries received up to the time of the impairment by any other method selected by the Sponsor in its sole discretion. The Sponsor reserves the right, in its sole discretion, to (1) change the dates of the Promotion Period of this Giveaway, with or without notice, in the event of inclement weather, technical failure, or for any other reason and (2) disqualify any individual that tampers with the entry process or the operation of this Giveaway, violates these Official Rules, or acts in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage or undermine the legitimate operation of this Giveaway may be a violation of criminal and civil laws. Persons suspected of tampering with this Giveaway, playing this Giveaway with a "non-human device," running "electronic scripts" to play this Giveaway or entering this Giveaway via more than one cell phone number or e-mail account will be disqualified. If disqualified, the Sponsor reserves the right to suspend and terminate entrants’ eligibility to further participate in the Giveaway during the Promotion Period. The Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

DISPUTES
Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Giveaway or a Prize shall be resolved individually without resort to any form of class action, and exclusively by the courts of record in the State of Washington in King County or the United States District Court, Washington (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway but in no event attorneys' fees; and (3) under no circumstances will an entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and the Sponsor  in connection with this Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Washington, without giving effect to any choice of law or conflict of law rules (whether of the State of Washington or any other jurisdiction) which would cause the application of the laws of any jurisdiction other than the State of Washington. All other applicable federal and state regulations apply.

RELEASE
By entering this Giveaway, entrants agree to release, discharge and hold harmless the Sponsor, Alltel, AT&T Wireless, Boost Mobile, Cricket Wireless, MetroPCS, T-Mobile, Verizon Wireless, Virgin Mobile and their related parent companies, and each of their respective officers, directors, employees, affiliates and agents (“Related Parties”) from and against any claim, cause of action, or damages including personal injury and/or death or property damage arising out of participation in this Giveaway or receipt, use, or misuse of a Prize.

LIMITATIONS OF LIABILITY
The Released Parties and Sponsor are not responsible for: (1) incorrect, inaccurate, late, lost, stolen, illegible, incomplete or misdirected mail, or entries received through impermissible or illegitimate channels, all of which will be disqualified; (2) technical failures of any kind, including but not limited to, the malfunctioning of any telephone, computer, network, hardware or software; (3) unauthorized human intervention in any part of the entry process; (4) electronic or human error which may occur in the administration of this Giveaway or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in this Giveaway, use or misuse of a Prize, or from downloading any material from the Sponsor's web site, regardless of whether the material was prepared by the Sponsor or a third party, and regardless of whether the material is connected to the Sponsor's website by a hypertext link.

WINNERS’ NAMES AND/OR COMPLETE OFFICIAL RULES
Each winner’s first initial, last name, city, and state will be provided upon request. For the names of the winners or a copy of these Official Rules, send a self-addressed, stamped envelope to be received by 5/15/09 to: Crush or Flush Giveaway Winners (or rules), 227 Bellevue Way NE #168, Bellevue, WA 98004 (Vermont residents may omit postage).

Crush or Flush, and it’s parent company IceBreaker, US Inc., is the sponsor of this Giveaway. Alltel, AT&T Wireless, Boost Mobile, Cricket Wireless, MetroPCS, T-Mobile, Verizon Wireless and Virgin Mobile are not sponsors of or participants in this Giveaway.
